Mobile Healthcare Partners, Inc. and Mobile Telemed, LLC,  (“MHP”, “we”, “us”, “our” or “Company”). We are a medical practice providing both in-home and Telemedicine Healthcare Services.

MHP is committed to ensuring that your personal information shared over our Site and/or Services is protected and kept confidential. By accepting our Company’s Terms of Use, providing information to us via our Site, or participating in our Telemedicine Platform, you consent to the use and disclosure of Personally Identifiable Information (PII) and Protected Health Information (PHI) as outlined in this Privacy Policy. Please note that the use and disclosure of such information is also subject to the practices of the healthcare providers with whom you may interact through the Services and Platform.

MHP operates the www.yourdoctorsathome.com and www.mobiletelemed.com websites (“Site(s)” or “Website(s)”) and provides Telemedicine services. This policy applies to our online website as well as to the services and applications/platform we provide, collectively known as the “Services” or “Platform”. This policy applies to any user of our website or Telemedicine Platform (“Users” or “Patients”), as well as any offline activities such as appointments or phone calls that relate to the use of our website or services.

Third Party Sites

This Privacy Policy applies only to information we collect at and through the Site and associated Services. Our Site also contains links to third party sites that are not owned or controlled by MHP. Please be aware that we are not responsible for the privacy practices of such other sites. We encourage you to be aware when you leave our Site(s) and to read the privacy statements of each and every website that collects personal information.

Children

Our Site or Platform is not designed or intended to appeal to minors and we do not knowingly collect PII or PHI from children under the age of 13.

What Types of Information Do We Collect?

Volunteered/Consented Information

Protected Health Information (PHI)

We collect data about health, DNA, medical records; data held by a hospital or doctor; past and current providers; insurance/financial information (credit card number, purchase history, invoices used only for billing information); and other similar data.

Information Obtained During Telemedicine or other E-Visits

Your provider may use and record your PII and PHI that is gathered during any telemedicine appointments, much like they would during an in person visit.

Information Submitted Via Email or Contact Forms

PLEASE NOTE: No private or secure information should be sent via our websites contact form, or to any published or discovered email address. Please do not submit information via these methods and refer to the individual contact pages for more information.

 

Information We Collect Through Your Use of our Site

Video and Audio Stream

Our Telemedicine Platform uses a secure video chat feature to connect providers and patients. This data may be securely stored, including your likeness and voice, for historical purposes and medical review.

Video and Audio Statistics

We may collect data about the usage of our Telemedicine Platform, including IP addresses, operating systems, device, and bandwidth statistics. This information helps us improve our platform.

Information automatically collected

In Short:   Some information — such as IP address and/or browser and device characteristics — is collected automatically when you visit our Services or Apps.

We automatically collect certain information when you visit, use or navigate the Services or Apps. This information does not reveal your specific identity (like your name or contact information) but may include device and usage information, such as your IP address, browser and device characteristics, operating system, language preferences, referring URLs, device name, country, location, information about how and when you use our Services or Apps and other technical information. This information is primarily needed to maintain the security and operation of our Services or Apps, and for our internal analytics and reporting purposes.

Online Identifiers – We collect devices; applications; tools and protocols, such as IP (Internet Protocol) addresses; cookie identifiers, or others such as the ones used for analytics and marketing; device’s geolocation; and other similar data.

Information collected through our Services/Platform/Apps

We may collect information regarding your geo-location, mobile device, push notifications, service, when you use our apps.

If you use our Apps, we may also collect the following information:

Geo-Location Information. We may request access or permission to and track location-based information from your mobile device, either continuously or while you are using our mobile application, to provide location-based services. If you wish to change our access or permissions, you may do so in your device’s settings.

Mobile Device Access. We may request access or permission to certain features from your mobile device, including your mobile device’s blue-tooth, camera, microphone, storage, and other features. If you wish to change our access or permissions, you may do so in your device’s settings.

Mobile Device Data. We may automatically collect device information (such as your mobile device ID, model and manufacturer), operating system, version information and IP address.

Push Notifications. We may request to send you push notifications regarding your account or the mobile application. If you wish to opt-out from receiving these types of communications, you may turn them off in your device’s settings.

 

How Do We Use Your Information?

We use personal information collected via our Services or Apps for a variety of business purposes described below, centered around the delivery of the practice Healthcare Services. We process your personal information for these purposes in reliance on our legitimate business interests, in order to enter into or perform a contract with you, with your consent, and/or for compliance with our legal obligations. We indicate the specific processing grounds we rely on next to each purpose listed below.

We use the information we collect or receive:

To facilitate the delivery of medical services to you. The primary use of all data and information gathered is to deliver the healthcare/medical services requested.

To respond to user inquiries/offer support to users. We may use your information to respond to your inquiries and solve any potential issues you might have with the use of our Services.

To facilitate account creation and recording process. We use the information collected to maintain an account and historical record of medical related information.

To send administrative information to you. We may use your personal information to send you product, service and new feature information and/or information about changes to our terms, conditions, and policies.

To enable patient-to-provider communications. We may use your information in order to enable patient-to-provider and other user-to-user communications with each user’s consent.

To enforce our terms, conditions and policies for Business Purposes, Legal Reasons and Contractual.

To respond to legal requests and prevent harm. If we receive a subpoena or other legal request, we may need to inspect the data we hold to determine how to respond.

 

For other Business Purposes. We may use your information for other Business Purposes. Business Purposes may include data analysis, identifying usage trends, determining the effectiveness of our promotional campaigns and to evaluate and improve our Services or Apps, products, marketing and your experience. We may use and store this information in aggregated and anonymized form so that it is not associated with individual end users and does not include personal information. Under HIPAA the Company may be a Business Associate of healthcare providers who use our Services. We may share information with healthcare providers who provide services to individuals, and they share information with us, for purposes related to treatment, payment and healthcare operations, and otherwise as agreed or authorized by you. In some cases, our Site contains links to other sites, including links to articles in third-party publications that are not directly affiliated with MHP. We do not share your PHI or PII with those sites (unless you specifically authorize such sharing) and are not responsible for their privacy procedures. We may process or share data based on the following legal basis:

Consent: We may process your data if you have given us specific consent to use your personal information in a specific purpose.

Legitimate Interests: We may process your data when it is reasonably necessary to achieve our legitimate business interests regarding medical services and treatment.

Performance of a Contract: Where we have entered into a contract with you, we may process your personal information to fulfill the terms of our contract.

Examples include: payment processing, secure video chat, telemedicine, etc. We may allow selected third parties to use tracking technology on the Services or Apps, which will enable them to collect data about how you interact with the Services or Apps over time. This information may be used to, among other things, analyze and track data, determine the popularity of certain content and better understand online activity. Business Transfers – We may share or transfer your information in connection with, or during negotiations of, any merger, sale of company assets, financing, or acquisition of all or a portion of our business to another company.

Third-Party Advertisers/Analytic Trackers – We do not use any third party tracking or advertising mechanisms to provide personalized ad content.

How Long Do We Keep Your Information?

We will only keep your personal information for as long as it is necessary for the purposes set out in this privacy policy, unless a longer retention period is required or permitted by law (such as tax, accounting or other legal requirements). No purpose in this policy will require us keeping your personal information for longer than 7 years.

When we have no ongoing legitimate business need to process your personal information, we will either delete or anonymize it, or, if this is not possible (for example, because your personal information has been stored in backup archives), then we will securely store your personal information and isolate it from any further processing until deletion is possible.
